Open House Visitors, LLC (“Open House Visitors,” “we,” “us,” or “our”) respects your privacy and is committed to protecting personal information. This Privacy Policy applies to our website, open-house visitor registration services, QR-code experiences, account features, advertising and business services, communications, and other services that link to this Privacy Policy (collectively, the “Services”). Our Services are intended for individuals 18 years of age or older.
1. Scope of This Privacy Policy
This Privacy Policy applies to personal information processed by Open House Visitors in connection with the Services.
Depending on your interaction with Open House Visitors, you may be an open-house visitor, individual real estate agent, real estate team member, team lead, brokerage administrator, advertiser, marketing representative, mortgage or lending partner, other business user, or visitor to our website.
Certain real estate professionals, brokerages, advertisers, lenders, and other businesses that interact with Open House Visitors are independent businesses with their own privacy practices and legal obligations. When one of those parties independently processes personal information outside the Open House Visitors Services, that third party's privacy notice and practices may apply.
Open House Visitors remains responsible for personal information that Open House Visitors itself controls or processes in accordance with this Privacy Policy and applicable law.
2. What Is Personal Information?
For purposes of this Privacy Policy, “personal information” or “personal data” generally means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household.
Personal information generally does not include information that has been properly aggregated or de-identified so that it cannot reasonably be associated with or linked to an identifiable individual or household.
3. Personal Information We Collect From Open-House Visitors
The personal information we collect depends on how you interact with the Services. When you register or sign in at an open house, we may collect:
- Your full name, email address, and mobile telephone number.
- The property or open house you visited and the date and time of your visit.
- Whether you indicate that you are currently working with a Realtor or other real estate professional.
- Whether you indicate that your real-estate interest is buying, selling, buying and selling, or just browsing.
- Your consent selections and communication preferences.
- Telephone-number verification status when Safety First is enabled.
- Information associated with your registration and use of the Services.
- Other information you voluntarily provide through an authorized feature of the Services.
We may also maintain records relating to the notice and consent choices presented to you, including the applicable version of consent language, your selection, date and time, IP address, browser or device information, and other information reasonably necessary to document the transaction, maintain security, prevent abuse, and demonstrate compliance.
4. Information We Collect Automatically
When you access or use the Services, we or service providers acting on our behalf may automatically collect information such as IP address, browser type and version, device type, operating system, pages or screens viewed, dates and times of access, referring or exit pages, website and application interactions, session information, security and fraud-prevention signals, cookie and similar technology identifiers, approximate geographic information derived from an IP address, and technical information necessary to operate, secure, diagnose, and improve the Services.
Open House Visitors does not require access to an open-house visitor's device-based precise GPS location to complete an open-house registration. We may process the address of the open house you visit and may derive approximate location information from your IP address for purposes such as security, fraud prevention, analytics, advertising where permitted, and platform operations.
5. Safety First Phone Verification
Certain open houses may use our optional “Safety First” telephone-number verification feature. When Safety First is enabled, Open House Visitors may use a third-party communications provider to send a one-time verification code to the mobile telephone number provided by the visitor. We may record whether the number was successfully verified together with related security, fraud-prevention, and audit information.
6. Consent Records
Where consent or another affirmative choice is requested through the Services, Open House Visitors may maintain records including the consent or disclosure language presented, applicable version, whether the choice was accepted or declined, date and time, associated open house, applicable business partner where relevant, IP address, browser or device information, and other information reasonably necessary to document the choice and demonstrate compliance.
Open House Visitors may retain limited consent and opt-out records beyond the ordinary retention period for visitor leads when reasonably necessary to document consent, honor opt-outs, maintain suppression lists, resolve disputes, establish compliance, or satisfy legal obligations.
7. Information About Agents, Brokers, Teams, Advertisers, and Business Users
If you create, administer, or use a professional or business account, we may collect name, professional contact information, account and authentication information, real-estate license information where applicable, brokerage/team/company affiliation, business address and office information, profile photograph, logos and branding, open houses created or administered, account settings, notification preferences, team invitations and memberships, account roles and permissions, advertising or sponsorship information, geographic assignments or service areas, communications with Open House Visitors, account activity, login information, device and IP information, security information, and audit information.
We use this information to create and administer accounts, authenticate users, provide the Services, manage teams and brokerages, operate open houses, provide advertising services, communicate with business users, provide support, maintain security, prevent fraud, enforce agreements, improve the Services, and satisfy legal obligations.
8. Payment Information
Open House Visitors may offer paid advertising, sponsorships, business accounts, or other paid services. Where payment is required, payments may be processed through a third-party payment processor.
Open House Visitors does not intend to directly store complete payment-card numbers or card security codes. We may receive and retain transaction-related information such as billing contact information, invoice information, transaction amount, transaction date, payment status, and limited payment-method information supplied by a payment processor, such as card brand and the last four digits of a payment card.
9. Information We Do Not Intentionally Collect Through Visitor Sign-In
The ordinary Open House Visitors registration experience is not designed to collect Social Security numbers, driver's-license numbers, passport numbers, other government identification numbers, bank-account information, complete payment-card information, credit reports or credit scores, detailed income/asset/debt information, mortgage application information, precise device-based GPS location, biometric identifiers, medical or health information, third-party account passwords, or background-check/criminal-history information.
Visitors and business users should not submit unnecessary sensitive information through notes, free-text fields, or other portions of the Services.
10. Mortgage Application Information
Open House Visitors is not a mortgage application or mortgage underwriting service. If you separately choose to interact with E Mortgage Capital, Inc. (“EMC”) regarding financing, EMC may separately request information necessary for mortgage financing, including financial, credit, employment, identity, asset, debt, or other information.
Such information should be collected separately by EMC through EMC's systems and subject to EMC's privacy notices and legal obligations. Open House Visitors does not receive a visitor's subsequent mortgage application, credit report, income information, banking information, underwriting information, loan information, or similar mortgage application information merely because the visitor was originally referred to EMC through Open House Visitors.
11. Information Received From Other Sources
We may receive appropriate information from agents, teams and brokerages; business users and advertisers; EMC in connection with operational information concerning an authorized referral; communications providers; authentication and security providers; email and SMS delivery providers; address and mapping providers; fraud and abuse-prevention providers; analytics and advertising providers; publicly available business or professional sources; commercially available property/address/ZIP code/county/licensing or similar business information; and activity generated through the Services.
Open House Visitors does not purchase consumer lead lists or append purchased consumer-profile information to an identifiable open-house visitor merely because that person registered at an open house.
12. How We Use Personal Information
We may use personal information to provide and operate the Services; register visitors; associate visitors with the appropriate property and hosting professional; provide visitor information to authorized hosting professionals; provide optional Safety First phone verification; send lead notifications; create and maintain accounts; authenticate users; manage QR codes, open-house links, signs, dashboards, reports and exports; respond to inquiries; provide support; maintain permissions and consent records; process optional EMC referrals when authorized; send service, security, transactional or permitted marketing communications; maintain suppression records; personalize and improve the Services; understand usage; create aggregated or de-identified analytics; provide and measure advertising; protect the Services; detect and prevent fraud or abuse; investigate disputes; enforce agreements; comply with legal and regulatory requirements; establish, exercise or defend legal claims; respond to emergencies where permitted by law; and carry out other purposes disclosed at collection or with your direction or consent.
13. Hosting Real Estate Professionals, Teams, and Brokerages
When you register for an open house, information you provide is made available to the real estate professional hosting or responsible for that open house and, where applicable and authorized, that professional's team or brokerage.
Authorized recipients may include the hosting real estate professional, authorized team members, team leads, and brokerage administrators. Information available to authorized real estate recipients may include name, email address, mobile telephone number, property/open house visited, date and time of visit, stated real-estate intent, whether you indicated you are currently working with a Realtor or real estate professional, and telephone verification status where applicable.
Visitor information is not made generally available to unrelated agents, teams, brokerages, advertisers, or other Open House Visitors customers.
14. Communications From the Hosting Real Estate Professional
A hosting real estate professional may use information submitted through open-house registration to communicate with you regarding the property you visited, respond to your inquiries, provide information you request, discuss the open house, and offer related real-estate assistance, subject to applicable law.
Registration through Open House Visitors does not independently grant a real estate professional unlimited permission to send communications that require separate consent under applicable law. Real estate professionals, teams, and brokerages are responsible for complying with applicable telephone, text-message, email, advertising, marketing, real-estate, and privacy requirements when independently using visitor information.
15. Independent Processing by Real Estate Professionals
Authorized agents, teams, and brokerages may export legitimate open-house leads to their own customer relationship management systems or other business systems and may independently process that information for legitimate real-estate-related purposes, subject to applicable law.
Once an authorized real estate professional, team, or brokerage independently processes personal information outside the Open House Visitors Services, that organization's own privacy practices, agreements, and legal obligations may apply. Open House Visitors remains responsible for information Open House Visitors itself controls or processes.
16. Optional Sharing With E Mortgage Capital, Inc. (“EMC”)
Open House Visitors may provide certain visitor information to E Mortgage Capital, Inc. (“EMC”) only when the visitor separately and affirmatively opts in to that disclosure and related communications.
When a visitor affirmatively opts in, Open House Visitors may provide EMC only with full name, email address, mobile telephone number, property or open house visited, date and time of visit, stated intent of Buy/Sell/Buy & Sell/Just Browsing, and the visitor's Yes/No response concerning whether the visitor is currently working with a Realtor.
Open House Visitors does not provide EMC with the visitor's IP address, device or browser information, one-time verification code, Safety First security metadata, internal security information, or internal audit records as part of the ordinary lead referral.
17. EMC Communications
When a visitor separately and affirmatively opts in to EMC, EMC may contact the visitor by telephone call, SMS/text message, and email regarding mortgage financing, prequalification or preapproval, mortgage programs, financing options, and other mortgage-related products or services relevant to the visitor's real-estate interests, consistent with the visitor's consent and applicable law.
Consent to EMC communications is not required to sign into an open house, tour a property, purchase property, obtain financing, or receive other ordinary Open House Visitors or hosting-agent services. EMC will be specifically identified to the visitor before the visitor is asked to provide the optional consent. Acknowledging this Privacy Policy or accepting the Open House Visitors Terms of Use does not constitute EMC consent.
18. Withdrawal of EMC Consent and Opt-Outs
A visitor may withdraw or opt out of future EMC marketing communications as provided by applicable law and the communication method involved. Withdrawal operates prospectively and cannot reverse a disclosure that was lawfully made to EMC before the withdrawal.
If a visitor opts out of EMC marketing communications, Open House Visitors may maintain an appropriate suppression record. Attending another open house does not automatically restore previously withdrawn EMC consent. A visitor must provide a new affirmative EMC consent before Open House Visitors may again treat the visitor as having newly authorized an EMC referral.
Existing EMC consent does not automatically authorize Open House Visitors to provide visitor information to another lender, title company, escrow company, home-warranty company, advertiser, or other future partner.
19. Advertising and Sponsorship Partners
Open House Visitors may display advertisements, sponsorships, company information, or representative information from third-party businesses. The presence of an advertisement or sponsorship does not itself authorize Open House Visitors to provide that advertiser or sponsor with identifiable visitor information.
Unless a visitor separately and affirmatively authorizes a disclosure or another lawful basis applies, advertisers and sponsors do not receive a visitor's name, email address, telephone number, property-specific registration responses, Realtor status, buying/selling intent, phone-verification information, or other identifiable visitor registration information merely because the company advertises on the Services.
Open House Visitors may provide advertisers or sponsors with aggregated or properly de-identified information that does not reasonably identify an individual visitor.
20. Cookies and Similar Technologies
Open House Visitors and service providers may use cookies, pixels, tags, SDKs, local storage, and similar technologies for essential website functionality, authentication, session management, security, fraud and abuse prevention, remembering preferences, performance monitoring, analytics, conversion measurement, advertising, and measuring marketing effectiveness.
Some technologies are necessary for the Services to function properly. Other technologies, including certain advertising or targeting technologies, may be subject to your privacy choices.
21. Advertising and Marketing Technologies
Open House Visitors may use advertising and marketing technologies provided by companies such as Meta/Facebook, Google (including Google Ads), TikTok, LinkedIn, and comparable advertising or measurement providers.
Depending on configuration and your choices, these technologies may process IP address, browser and device information, cookie or advertising identifiers, pages viewed, referring pages, website interactions, and conversion or campaign activity.
Certain disclosures involving advertising technologies may constitute a “sale,” “sharing,” cross-context behavioral advertising, or targeted advertising under applicable state privacy laws even where Open House Visitors does not sell a visitor list for money.
22. Protection of Open-House Registration Data From Advertising Pixels
Open House Visitors maintains a privacy boundary between identifiable open-house visitor registration information and advertising technologies. Advertising and retargeting pixels may operate on the general Open House Visitors marketing website subject to applicable privacy choices.
Open House Visitors does not intentionally permit advertising or retargeting pixels to receive visitor names, email addresses, telephone numbers, Realtor status, buying or selling intent tied to an identifiable visitor, EMC consent choices, one-time verification codes, phone-verification status, consent records, or free-text visitor information entered into the actual registration flow.
Open House Visitors also does not upload identifiable open-house visitor records to advertising platforms merely because an individual signed into an open house for purposes of creating customer-match, custom, retargeting, lookalike, similar audiences, or advertising-profile enrichment.
23. Your Privacy Choices for Advertising Technologies
Where applicable, Open House Visitors will provide privacy controls that may include Accept All, Reject Non-Essential, and Manage Preferences.
The website will also provide access to Your Privacy Choices and, where applicable, a Do Not Sell or Share My Personal Information mechanism. Rejecting non-essential advertising or targeting technologies will not prevent you from completing an ordinary open-house registration or using essential Safety First functionality.
Where required by applicable law, Open House Visitors will recognize supported browser-based opt-out preference signals, such as Global Privacy Control (“GPC”). Cookie and advertising preferences may be browser-, website-, or device-specific depending on the technology involved.
24. Service Providers and Contractors
We may disclose personal information to service providers and contractors that perform services on our behalf, including providers of cloud hosting, database services, authentication, file storage, SMS communications, phone verification, email delivery, address and mapping services, security and fraud prevention, analytics, advertising measurement, application monitoring, diagnostics, customer support, payment processing, and technical infrastructure.
Providers may include companies such as Supabase, Amazon Web Services (“AWS”), Twilio, Resend, Google, Cloudflare, Meta, TikTok, LinkedIn, and comparable or replacement providers. Where appropriate and legally applicable, Open House Visitors requires service providers to protect personal information, use information for authorized purposes, and maintain appropriate safeguards.
Operational service providers are distinct from EMC lead referrals. For example, a communications provider may process a telephone number to send a requested verification code without receiving that information as a sales lead.
25. Communications and Delivery Records
Open House Visitors may maintain records generated when communications are sent through or in connection with the Services, including recipient email address or telephone number, message or delivery status, date and time, provider transaction or message identifier, delivery failures, email bounces, SMS STOP or HELP responses, unsubscribe status, spam or complaint status, and related technical delivery information.
We may use these records to operate and troubleshoot the Services, maintain deliverability, honor communication preferences, document consent and opt-outs, prevent fraud, maintain security, and comply with law.
The current Services do not record telephone calls between visitors and agents or EMC and do not provide Open House Visitors access to unrelated private emails, text messages, or telephone calls occurring outside our Services.
26. SMS and Email Choices
Where applicable, recipients of marketing SMS messages may reply STOP to opt out and HELP for assistance. Message frequency may vary, and message and data rates may apply.
Marketing emails will provide an unsubscribe mechanism where required. An opt-out from marketing communications does not necessarily prevent Open House Visitors from sending necessary transactional, administrative, security, account, or requested service communications, such as a requested one-time verification code.
27. Property and Open-House Information
Open House Visitors may process and publicly display information necessary to operate an open house, including property address, open-house date and time, hosting agent's name, professional contact information, license information, brokerage or team information, professional photograph, logo and branding, and other appropriate property or professional information.
A public open-house page or QR code does not make the associated visitor list public. Open House Visitors does not publicly display visitor names, visitor contact information, individual visitor registration history, EMC consent status, Realtor status, buying/selling intent, phone-verification status, or visitor consent/audit records merely because an open-house page is publicly accessible.
28. Sellers and Property Owners
Property ownership alone does not provide a seller or homeowner with direct access through Open House Visitors to the identities or contact information of people who registered at an open house.
Open House Visitors may support aggregated or de-identified reporting, such as total visitor counts, general open-house activity, aggregated feedback, and general visitor-interest trends. A real estate professional may independently provide information to a seller where appropriate as part of the professional's representation and subject to that professional's legal and privacy obligations.
29. Changes in Property Ownership or Representation
Historical visitor records remain associated with the open house, hosting professional, and authorized team or brokerage under which they were originally collected.
A subsequent property sale, ownership change, listing withdrawal, listing expiration, relisting, change of listing agent, change of team, or change of brokerage does not automatically transfer access to historical visitor records to a new owner, agent, team, or brokerage.
30. Accuracy of Visitor Information
You should provide accurate information that belongs to you and should not impersonate another person or knowingly submit another person's personal information without authorization.
Open House Visitors may take reasonable measures to validate information, prevent fraud, protect the Services, and correct, restrict, or remove information we reasonably believe is inaccurate, fraudulent, unauthorized, or submitted in violation of our Terms of Use.
Open House Visitors cannot independently guarantee the accuracy of all information submitted by visitors. Safety First telephone verification confirms access to a telephone number only and does not independently establish identity or verify the accuracy of other information.
31. Notes and Free-Text Information
Notes and other free-text fields provided to agents, administrators, or other business users are intended for legitimate business information related to the open house and appropriate real-estate follow-up.
Users should not enter unnecessary sensitive information into those fields, including Social Security numbers, financial-account information, complete payment-card information, government identification numbers, passwords, medical information, biometric information, detailed credit information, or mortgage application information. Open House Visitors may remove or restrict prohibited or inappropriate information where reasonably necessary.
32. Aggregated and De-Identified Information
Open House Visitors may create, analyze, use, and disclose aggregated or properly de-identified information for legitimate purposes such as analytics, product development, market research, business planning, geographic and open-house trends, operational reporting, security, platform improvement, and advertiser or sponsor reporting.
Information is not considered de-identified merely because a person's name has been removed. Information maintained as de-identified must not reasonably identify an individual or household. Where we maintain information in de-identified form, we will not attempt to re-identify it except where required or permitted by applicable law, including where appropriate to test the effectiveness of de-identification procedures.
33. Automated Decision-Making and Artificial Intelligence
Open House Visitors does not use artificial intelligence, profiling, or automated processing to make decisions that produce legal or similarly significant effects concerning open-house visitors, including decisions concerning mortgage eligibility, creditworthiness, housing eligibility, employment, insurance, or similar legally significant opportunities.
Open House Visitors may use ordinary automation for routing visitor information, associating QR codes with open houses, sending notifications, fraud and abuse detection, security, analytics, organizing or filtering leads, geographic advertising placement, and ordinary platform operations. Mortgage underwriting, credit evaluation, prequalification, and lending decisions are not made by Open House Visitors.
34. Data Retention
Open House Visitors generally retains identifiable open-house visitor and lead information for 24 months from the visitor's most recent relevant interaction through the platform, after which the information will be deleted or de-identified unless longer retention is reasonably necessary or permitted for legal or regulatory obligations, consent documentation, opt-out and suppression records, fraud prevention, security investigations, disputes, enforcement of agreements, establishment or defense of legal claims, litigation or regulatory holds, or another legitimate purpose permitted by applicable law.
Registered user and business-account information may be retained while an account remains active and for an appropriate period afterward for contractual, accounting, security, fraud-prevention, dispute-resolution, legal, and compliance purposes. Properly aggregated or de-identified information may be retained as permitted by law.
35. Account Closure
Closing or terminating an agent, brokerage, advertiser, marketer, partner, or other registered account does not necessarily cause every historical record associated with that account to be immediately deleted.
Visitor records continue to follow our retention, privacy-request, deletion, security, and legal-compliance requirements. Limited consent, opt-out, audit, security, dispute, and compliance records may be retained longer where reasonably necessary or permitted by law.
36. Backups and Disaster Recovery
Information deleted from active systems may temporarily remain in secured backup or disaster-recovery systems until those backups are deleted, overwritten, or cycled out pursuant to our ordinary backup-retention procedures.
Information retained only in backups is not intended to be restored to ordinary active use except where necessary for disaster recovery, security, legal compliance, or other legitimate purposes. If information is restored from a backup, we will take reasonable steps to continue honoring applicable deletion, opt-out, or suppression requirements.
37. Data Security
Open House Visitors uses reasonable administrative, technical, and organizational safeguards designed to protect personal information. Depending on the system and information involved, safeguards may include encryption in transit, encryption at rest through applicable infrastructure providers, role-based access controls, database-level access restrictions, multi-factor authentication for privileged administrative accounts, secure authentication practices, restricted administrative access, rate limiting, automated-abuse protections, OTP abuse protections, secure credential and API-secret management, logging and security monitoring, audit records for sensitive administrative actions, secure file-upload controls, environment separation, backup and recovery procedures, and appropriate vendor security controls.
38. Security Incidents
Open House Visitors maintains processes designed to identify, investigate, contain, document, respond to, and mitigate security incidents involving personal information.
If we determine that a security incident involving personal information requires notification under applicable law, we will provide notice to affected individuals, governmental authorities, regulators, or other parties as required by applicable law. Not every attempted attack, blocked intrusion, suspicious login, or technical security event constitutes a legally reportable data breach.
39. Data Processing Locations
Open House Visitors is based in the United States. Our operational standard is to use U.S.-based primary production hosting and storage for identifiable visitor information where reasonably available.
Personal information may nevertheless be processed in the United States and other locations where Open House Visitors or its service providers maintain facilities or conduct operations. Privacy and data-protection laws in those locations may differ from the laws where you reside. Where required by applicable law, we take appropriate measures concerning transfers of personal information.
40. Legal and Security Disclosures
We may disclose personal information where we reasonably believe disclosure is required or permitted to comply with applicable law or regulation; respond to valid subpoenas, warrants, court orders, or other legal process; respond to lawful governmental or regulatory requests; establish, exercise, or defend legal claims; enforce agreements or Terms of Use; investigate disputes; prevent, investigate, or address fraud, abuse, or security incidents; protect Open House Visitors' rights or property; protect users, customers, business partners, or others; or address emergencies involving a substantial threat to health or safety where legally permitted.
41. Government and Law-Enforcement Requests
Open House Visitors does not treat visitor information as automatically available to governmental or law-enforcement authorities merely upon request.
We may review governmental requests for appropriate legal authority and, where permitted by law, may object to or seek to narrow requests we reasonably believe are improper, overbroad, or legally deficient. Where legally permitted and appropriate, we may notify an affected individual regarding a governmental request before disclosure.
We may refrain from providing notice where notice is legally prohibited, an emergency makes notice inappropriate, or another lawful reason prevents notification.
42. Business Transactions
We may disclose or transfer personal information in connection with an actual or proposed merger, acquisition, financing, corporate reorganization, joint venture, sale of assets, sale of the company, insolvency, bankruptcy, receivership, or similar corporate transaction.
A business transfer does not automatically eliminate privacy protections applicable to personal information. Any successor's processing remains subject to applicable law and applicable privacy commitments governing the information, except to the extent those commitments are lawfully modified following any notice or consent required by law.
43. Third-Party Websites and Services
The Services may contain links to websites, applications, social-media services, or other services operated by third parties. When you leave Open House Visitors or interact directly with an independent third party, that third party's privacy notice and practices may apply.
Except where expressly stated otherwise, Open House Visitors does not control the independent privacy practices of third-party websites and services. This provision does not eliminate Open House Visitors' responsibility for disclosures Open House Visitors itself makes under this Privacy Policy, including an authorized disclosure to EMC.
Open House Visitors does not intentionally place visitor names, email addresses, telephone numbers, or other sensitive visitor information in external-link URLs or query strings.
44. Children and Minors
The Services are intended for individuals 18 years of age or older. Individuals under 18 should not independently submit personal information through the Services or opt in to EMC mortgage or lending communications.
Open House Visitors does not require visitors to provide a date of birth through the ordinary open-house registration process and may instead use an age acknowledgment. If we learn that we have collected personal information from a child in circumstances prohibited by applicable law, we will take reasonable steps to delete or otherwise appropriately address that information.
45. Financial Incentives
Open House Visitors does not currently offer visitors payments, discounts, or another financial incentive in exchange for personal information as those concepts may be defined under applicable privacy laws.
Ordinary open-house registration is not conditioned on accepting non-essential advertising tracking, opting in to EMC, waiving applicable privacy rights, or permitting Open House Visitors to sell or share personal information for targeted advertising.
If Open House Visitors introduces a qualifying financial-incentive program in the future, we will provide any additional notice or consent required by applicable law before implementing the program.
46. Your Privacy Rights
Depending on your state of residence, applicable law, and certain legal limitations or exceptions, you may have the right to:
- Confirm whether we process your personal information.
- Know or access personal information we maintain about you.
- Obtain information about categories of personal information collected, sources, purposes, and recipient categories.
- Receive a portable copy of qualifying personal information.
- Correct inaccurate personal information.
- Request deletion of qualifying personal information.
- Opt out of qualifying sales or sharing of personal information.
- Opt out of targeted or cross-context behavioral advertising.
- Withdraw consent where processing is based on consent.
- Obtain a list of specific third parties to whom personal information was disclosed where applicable state law provides that right.
- Use an authorized agent where permitted by law.
- Appeal certain privacy-request decisions where applicable.
- Receive non-discriminatory treatment for exercising applicable privacy rights.
Not every right applies in every jurisdiction or circumstance.
47. Privacy Requests
You may submit an applicable privacy-rights request through our dedicated Privacy Request form available through our website or by contacting us at privacy@openhousevisitors.com.
Privacy questions and assistance are also available by telephone at (972) 569-7226.
We will respond to verified privacy requests within the time required by applicable law. Where permitted, applicable law may allow an extension. If an extension applies, we will provide notice as required. Qualifying privacy requests will ordinarily be processed without charge, subject to rights available under applicable law concerning requests that are manifestly unfounded, excessive, repetitive, or otherwise subject to an exception.
48. Verification of Privacy Requests
To protect personal information, we may verify your identity before fulfilling certain privacy requests. Verification will be proportionate to the nature and sensitivity of the request and information involved.
For ordinary visitor requests, we may verify control of an email address or mobile telephone number associated with our records. We do not intend to routinely require a Social Security number, government identification, credit information, banking information, or other unnecessary sensitive information merely to process an ordinary privacy request.
We may deny or limit a request where we cannot reasonably verify identity or authority, cannot reasonably locate applicable information, fulfilling the request would adversely affect another person's rights or privacy, an applicable legal exception applies, or the request may otherwise be denied or limited under applicable law.
Information submitted specifically for request verification will be used primarily for verification, security, fraud prevention, processing the request, and related legal compliance.
49. Authorized Agents
Where permitted by applicable law, you may authorize another person to submit a privacy request on your behalf. We may require reasonable evidence demonstrating that the representative is authorized to act for you and may independently verify your identity or authorization where permitted by law.
50. Appeals
Residents of jurisdictions providing a right to appeal certain privacy decisions may appeal a qualifying decision through the privacy contact methods identified in this Privacy Policy. We will process qualifying appeals in accordance with applicable law.
51. Non-Discrimination
Open House Visitors will not unlawfully discriminate or retaliate against you because you exercise an applicable privacy right. Exercising privacy choices may affect functionality only where the information or processing involved is reasonably necessary to provide a particular optional feature or where otherwise permitted by law.
Declining EMC consent, rejecting non-essential advertising technologies, or exercising an applicable privacy right will not prevent ordinary open-house registration.
52. U.S. State Privacy Disclosures
Certain U.S. states provide residents with specific rights regarding personal information. Depending on your state of residence and whether the applicable law applies to Open House Visitors or a particular processing activity, you may have some or all of the rights described in the “Your Privacy Rights” section above.
Applicable state law may define “sale,” “sharing,” “targeted advertising,” “sensitive data,” and related concepts differently.
Open House Visitors does not sell identifiable open-house visitor contact lists to unrelated third parties in exchange for money. However, certain disclosures involving advertising or marketing technologies may constitute “sale,” “sharing,” or targeted advertising under applicable state law even when no money is paid directly in exchange for a particular visitor's information.
Where required, Open House Visitors provides mechanisms to opt out of qualifying sale, sharing, or targeted advertising.
53. Right to a List of Specific Third Parties
Residents of jurisdictions that provide such a right may request a list of specific third parties, as defined under applicable law, to whom Open House Visitors has disclosed their personal information.
For example, where applicable and responsive to the request, a disclosure made pursuant to an affirmative EMC opt-in may identify E Mortgage Capital, Inc. (“EMC”) — Mortgage/Lending Partner.
Requests may be submitted through our Privacy Request process or by emailing privacy@openhousevisitors.com.
54. California Privacy Disclosures
This section supplements the remainder of this Privacy Policy for residents of California. California law may provide qualifying residents with rights concerning access, knowledge, correction, deletion, portability, sale or sharing, use of certain sensitive personal information, authorized agents, and non-discrimination, subject to applicable requirements and exceptions.
California Categories of Personal Information
During the applicable preceding period, depending on how an individual interacted with the Services, Open House Visitors may have collected or processed the following categories of personal information:
| California Category | Examples |
|---|---|
| Identifiers | Name, email address, telephone number, IP address, account identifiers and similar identifiers. |
| California Customer Records Information | Contact information, account information and certain professional information. |
| Commercial or Interaction Information | Property/open house visited, open-house interaction, visitor's stated real-estate intent, service interactions, and transaction records where applicable. |
| Internet or Other Electronic Network Activity | Browser/device information, pages viewed, website interactions, cookie identifiers, login activity, security logs and related technical information. |
| Approximate Geolocation Information | Approximate geographic information inferred from IP address and property/open-house location. Open House Visitors does not require visitor device-based precise GPS location for registration. |
| Professional or Employment-Related Information | Real-estate license information, brokerage, team, company, professional role and business contact information. |
| Inferences or Preferences | Limited preferences or characteristics derived from choices or interactions, such as stated Buy/Sell/Buy & Sell/Just Browsing intent, where legally categorized as an inference. |
| Sensitive Personal Information, where applicable | Account authentication credentials or similar information where legally classified as sensitive. The visitor registration system is not designed to collect visitor Social Security numbers, government IDs, financial-account credentials, precise GPS data, credit reports or mortgage application information. |
We may obtain these categories directly from you; from agents, teams, brokerages, business partners and service providers; automatically from browsers or devices; from public or commercial business/property sources; or from activity generated through the Services.
We use these categories for the business and commercial purposes described throughout this Privacy Policy, including providing the Services, open-house registration, account administration, security, fraud prevention, communications, authorized referrals, analytics, advertising, legal compliance, and platform improvement.
We may disclose these categories to the recipient categories described throughout this Privacy Policy, including authorized real estate professionals, service providers, EMC when separately authorized, legal or governmental recipients where appropriate, transaction counterparties in a corporate transaction, and advertising providers as described in our advertising disclosures.
Open House Visitors does not intentionally provide identifiable open-house visitor registration form data to advertising pixels or upload the identifiable visitor database to advertising platforms for custom or lookalike audiences merely because an individual signed into an open house.
Certain cookie, device, browser, advertising, or network information disclosed through advertising technologies may nevertheless constitute “sale” or “sharing” under California law. California residents may exercise applicable opt-out rights through Your Privacy Choices.
California Sensitive Personal Information
Open House Visitors does not use sensitive personal information collected through the ordinary visitor-registration experience to infer characteristics about visitors in a manner requiring a separate limitation right under applicable California law. The visitor sign-in system is specifically designed not to request Social Security numbers, government IDs, detailed financial information, mortgage application information, credit reports, or precise GPS information.
California Shine the Light
California's “Shine the Light” law may provide California residents with rights under certain circumstances concerning disclosure of certain personal information to third parties for their direct-marketing purposes. Qualifying requests may be submitted through our Privacy Request process or by emailing privacy@openhousevisitors.com.
55. Sale, Sharing, and Targeted Advertising Choices
Where applicable law provides the right, you may opt out of qualifying sale of personal information, sharing of personal information for cross-context behavioral advertising, or processing of personal information for targeted advertising.
You may exercise applicable choices through Your Privacy Choices on our website. Where legally required, Open House Visitors will also honor supported opt-out preference signals such as Global Privacy Control. These advertising-related privacy choices are distinct from the optional EMC consent process.
56. Changes to This Privacy Policy
We may update this Privacy Policy from time to time as our Services, technology, business practices, or legal obligations evolve. When we update this Privacy Policy, we will revise the Last Updated date and, where appropriate, the version number.
If we make a material change, we may provide additional notice through appropriate channels where required or appropriate, such as email, account notification, prominent website notice, or notice presented through the Services.
If applicable law requires consent before previously collected personal information may be used for a materially different purpose, Open House Visitors will obtain the required consent before using the information for that new purpose. Existing EMC consent will not automatically authorize a materially different use or disclosure to a different business partner.
57. Policy Version History
Open House Visitors maintains archived historical versions of this Privacy Policy and may associate relevant consent records with the version of applicable privacy or consent language in effect when the visitor made a particular choice.
This Privacy Policy is Version 1.0.
58. Terms of Use
This Privacy Policy describes Open House Visitors' privacy practices. Use of the Services may also be governed by our separate Terms of Use and other applicable agreements.
Acceptance of the Terms of Use or acknowledgment of this Privacy Policy does not constitute affirmative consent to receive EMC mortgage or lending communications. Where EMC consent is offered, it is presented as a separate choice.
